This End-User License Agreement (“License”) is a legal agreement between you (an individual or a single entity) and NatureServe for the software product “the Climate Change Vulnerability Index.” By downloading, copying, or otherwise using the Climate Change Vulnerability Index, you agree to be bound by the terms of this License. If you do not agree to the terms of this License do not download, install or use the Climate Change Vulnerability Index.
The Climate Change Vulnerability Index is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The Climate Change Vulnerability Index is licensed, not sold. The definition of the Climate Change Vulnerability Index includes computer software, associated media and product documentation consisting of both printed and digital material.
This License grants you the right to install and use an unlimited number of copies of the Climate Change Vulnerability Index for personal non-commercial use only. You may not sell for profit, incorporate into any commercially sold software application or distribute the Climate Change Vulnerability Index without first obtaining written approval from NatureServe.
All title and copyrights in and to the Climate Change Vulnerability Index (including but not limited to any images, animations, video, audio, music, text and applets incorporated into the Climate Change Vulnerability Index ), any accompanying printed materials, all and any copies of the Climate Change Vulnerability Index are owned by NatureServe. The Climate Change Vulnerability Index is protected by copyright laws and international treaty provisions as well as by other intellectual property laws and treaties. Therefore, you must treat the Climate Change Vulnerability Index like any other copyrighted material.
NatureServe expressly disclaims any warranty for the Climate Change Vulnerability Index. The Climate Change Vulnerability Index and any related documentation is provided “as is” without warranty of any kind, either express or implied, including, without limitation, the implied warranties or merchantability, fitness for a particular purpose, or non infringement. The entire risk arising out of use or performance of the Climate Change Vulnerability Index remains with the user. In no event shall NatureServe be liable for any damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other financial loss) arising out of the use of or inability to use the Climate Change Vulnerability Index, even if NatureServe has been advised of the possibility of such damages.
